Information on the Processing of Personal Data pursuant to Legislative Decree No. 196/2003 and Articles 13 and 14 of Regulation (EU) 2016/679

We wish to inform you that Legislative Decree number 196 of June 30, 2003 (“Personal Data Protection Code” or “Privacy Code”), as well as Regulation (EU) 2016/679, establish and guarantee the right to the protection of personal data subject to processing by third parties, in accordance with the principle that every individual has the right to the protection of their personal data concerning them, as well as the processing of such data in respect of fundamental rights and freedoms, the dignity of the data subject, with particular reference to confidentiality and personal identity.

For the purposes of this information related to the Privacy Code and the European Regulation, the following concepts are understood:

5. “Sensitive data” are personal data suitable for revealing racial or ethnic origin, religious, philosophical, or other beliefs, political opinions, membership in parties, trade unions, associations, or organizations of a religious, philosophical, political, or trade union nature, as well as personal data suitable for revealing health status and sexual life.
6. The “data controller” is the natural person, legal entity, public authority, service, or other body that, alone or jointly with others, determines the purposes and means of processing personal data.
7. The “data processor” is the natural person, legal entity, public authority, service, or other body that processes personal data on behalf of the data controller.
8. “Authorized personnel” are individuals authorized to perform processing operations by the data controller or data processor.
9. The “data subject” is the identified or identifiable natural person to whom the personal data refer.
10. “Communication” refers to disclosing personal data to one or more specific entities other than the data subject, the data controller’s representative within the State territory, the data processor, and the authorized personnel, in any form, including making them available or consultation.
11. “Dissemination” means disclosing personal data to indeterminate subjects, in any form, including making them available or consultation.
12. “Anonymous data” refers to data that cannot be associated with an identified or identifiable data subject, either originally or after processing.
13. “Blocking” is the retention of personal data with the temporary suspension of all other processing operations.
14. “Data bank” refers to any organized set of personal data divided into one or more units located in one or more sites.
15. “Guarantor” refers to the authority established by Law No. 675 of December 31, 1996, Article 153.
16. “Minimum measures” refer to the set of technical, IT, organizational, logistical, and procedural security measures that constitute the minimum level of protection required in relation to the risks envisaged in Article 31 of the Privacy Code.

In accordance with Article 5 of Regulation 2016/679, the processing of the data you provide will be guided by the principles of lawfulness, fairness, and transparency. It will be carried out while respecting the principle of data minimization, configuring our computer systems and programs in such a way as to minimize the use of personal and identifying data. This is to avoid processing when the pursued purposes can be achieved, in individual cases, through anonymous data and appropriate methods that allow identification only when necessary.

In case of violation of your personal data, ADAGIO SRL will take care of notifying, according to art. 33 Regulation (EU) without undue delay, where possible within 72 hours from the moment it has become aware of it, such violation to the authority Guarantor of Privacy. Such notification will take place in all cases unless the personal data breach is unlikely to present a risk to the rights and freedoms of natural persons. If the personal data breach is likely to present a high risk for the rights and freedoms of natural persons, ADAGIO SRL, the data controller, will notify you of the breach without undue delay.

 

Changes to our privacy policy

Considering that the state of perfection of the automatic control mechanisms does not currently make them free from errors and dysfunctions, we reserve the right to make, without prior notice, any changes to this privacy policy that we deem necessary or that will be mandatory by law or other regulatory source.
